Welcome to PomoGo ("the App"). These Terms & Conditions ("Terms") govern your access to and use of the App, which is a personal project owned and developed by NAIM DRIDI PODADERA ("the Developer", "we", "us", or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Acceptance of Terms

By accessing or using PomoGo, you confirm that you are at least 13 years of age (or the age of digital consent in your jurisdiction) and that you accept and agree to comply with these Terms and our Privacy Policy.

2. Description of the Service

PomoGo is a productivity and wellness application that combines a Pomodoro-style focus timer with guided micro-workout breaks (the "Smart Dictator" concept). The App includes features such as offline-first local data storage with optional Firebase cloud sync, anonymous authentication, gamification (streaks, points, and achievements), and personalized exercise recommendations.

3. Health & Physical Activity Disclaimer

IMPORTANT — PLEASE READ CAREFULLY:

PomoGo suggests physical exercises and micro-workouts during break periods. These exercises are general in nature and are not medical advice. By using the App, you acknowledge and agree that:

• You are solely responsible for your own physical health and safety when performing any exercises suggested by the App.
• You should consult a qualified healthcare professional before beginning any exercise program, especially if you have pre-existing medical conditions, injuries, or physical limitations.
• The Developer is not a medical professional, personal trainer, or licensed health provider.
• The Developer shall not be held liable for any injury, illness, damage, or loss resulting from performing exercises suggested by the App. You perform all exercises at your own risk.
• You may skip or modify any exercise at any time if you feel discomfort or pain.

4. User Accounts

The App creates an anonymous account for you upon first use. No personal identifying information (such as name or email) is required. You are responsible for any activity that occurs under your anonymous account and for maintaining the security of your device.

5. Subscriptions & In-App Purchases

Future versions of PomoGo may include premium features available through auto-renewable subscriptions. These subscriptions will be managed via RevenueCat and processed through the Apple App Store (iOS) and Google Play Store (Android). By subscribing, you agree to the following:

• Payment: Payment will be charged to your Apple ID or Google Play account at confirmation of purchase.
• Auto-Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period.
• Renewal Charge: Your account will be charged for renewal within 24 hours prior to the end of the current period, at the same price as the original subscription.
• Managing Subscriptions: You can manage and cancel your subscriptions by going to your account settings on the App Store or Google Play Store after purchase.
• Free Trials: If offered, any unused portion of a free trial period will be forfeited when you purchase a subscription.
• Refunds: Refund requests are handled by Apple or Google according to their respective refund policies. The Developer does not process refunds directly.

Subscription pricing and features will be clearly communicated within the App before any purchase is made.

6. Intellectual Property

All content, designs, code, graphics, logos, and trademarks within the App are the intellectual property of NAIM DRIDI PODADERA unless otherwise stated. You may not copy, modify, distribute, or create derivative works based on the App or its content without prior written consent.

7. Limitation of Liability

To the fullest extent permitted by applicable law:

• The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied.
• The Developer does not warrant that the App will be uninterrupted, error-free, or free of harmful components.
• In no event shall the Developer be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, revenue, or profits, arising out of or in connection with your use of the App.
• The Developer's total cumulative liability to you shall not exceed the amount you have paid for the App or its subscriptions in the twelve (12) months preceding the claim, or USD $50, whichever is greater.

8. Indemnification

You agree to indemnify, defend, and hold harmless the Developer from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney fees) arising out of or related to your use of the App, your violation of these Terms, or your violation of any rights of another party.

9. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive.

10. Third-Party Services

The App may integrate with third-party services including but not limited to Firebase (Google), RevenueCat, Apple HealthKit, and Google Fit. Your use of these services is subject to their respective terms and privacy policies. The Developer is not responsible for the practices of any third-party service.

11. Modifications to These Terms

We may revise these Terms at any time by posting the updated version on this page. The "Last updated" date at the top indicates when the Terms were last revised. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Spain, without regard to its conflict-of-law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Spain.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.
